Medicare Liens

Medicare liens and set asides on Utah senior injury claims

When Medicare pays medical expenses for an injury caused by the fault of another person, federal laws (Medicare Secondary Payer laws) give Medicare the right to reimbursement from the wrongdoer. This puts the injured senior in a difficult position. These points are important:

  • Federal law requires all insurance companies to report insurance payments over $300 to any senior over 65 years of agewoman in wheelchair making a senior injury claim
  • All insurance companies require clearance by Medicare before settling a claim when medical expenses have been paid by Medicare
  • Medicare maintains a lien for reimbursement of its medical expenses on all settlements and payments of money to an injured senior
  • Medicare claims a right to reimbursement from all future medical expenses covered by a settlement or insurance payment
  • Medicare wants seniors to establish a special set-aside account for money received from a settlement of future medical expenses
  • A senior who violates the Medicare rules and law risks being penalized, fined and even suspended from Medicare
  • Many Utah injury lawyers are unaware of Medicare liens and set-aside requirements
  • Lawyers who do not understand Medicare liens and set-aside laws can cause serious problems for injured Utah seniors
  • Misunderstandings with Medicare delay or even stop settlements of hundreds of injury claims in Utah every year.

You need a Utah senior injury lawyer who understands your case

If you have a senior injury claim, you need a Utah lawyer who understands Medicare liens and set-aside laws.  Attorney Jack Helgesen and Senior Paralegal Tonya Hardy of Helgesen, Houtz & Jones are among only a handful of professionals in America who hold the esteemed Certified Medicare Secondary Payer Professional (CMSP) certifications. Senior Injuries

Senior injury lawyers in northern Utah

Many senior citizens are at greater risk for injury. Senior injury lawyers Jack Helgesen (Layton) and Michael Houtz (Ogden) have a special interest in senior injuries cases. Many lawyers avoid these types of cases because seniors often have pre-existing medical problems and because many other elements of a damage award may be more difficult to establish.

Fall-related injuries

Senior injuries can occur at any time – either because of abuse or negligence. However, many senior injuries occur as a result of falls, which usually cost up to $30,000 in treatment.

Fall-related injuries tend to be more serious for seniors and may occur because of neglect from caretakers – whether it’s in the victim’s own home or in a nursing home – from poor lighting or badly placed rugs. Besides high medical bills, fall-related injuries can lead to disability or accidental death. Not only that, but they can severely limit a victim’s quality of life and inflict psychological damage.

Nursing home abuse and neglect

We all want what’s best for our loved ones. The decision to place an aging relative in a nursing home is never an easy one. Even with careful research, nursing home abuse and neglect can still occur.

In fact, it is estimated that about five million seniors are abused each year but only one in four cases are reported to the proper authorities. While most abusers are someone the victims know and trust, abuse still occurs in nursing homes.

Although elder abuse is a serious problem, neglect is more common in nursing homes than abuse. It’s estimated that about 15 percent of elder abuse cases stem from neglect. Nursing home neglect and abuse can occur as a result of different issues including:

  • Undertrained staff
  • Too few employees
  • Lack of elder abuse/neglect education
  • The nursing home or care facility does not do a thorough job vetting employees
  • Defective products such as medical devices and wheelchairs
  • Improper lighting and furnishings that can cause accidents

Some of the signs of elder abuse/neglect are:

  • Bedsores
  • Injuries, such as lacerations and bruises
  • Mental health problems
  • Isolation
  • Malnutrition
  • Medication not being dispensed properly

While this is not a comprehensive list, these are some of the reasons you or a loved one may be entitled to compensation from a senior injury case.

If you or a loved one has been a victim of abuse or neglect in a nursing home, contact us today for a free case evaluation.

Slip and Fall Injuries

Seniors may be due compensation for their accidents and injuries

Slips and falls cause serious injuries to seniors — falls are common among seniors over age 65.

One out of three seniors over the age of 65 falls annually in the United States, resulting in over a million both fatal and non-fatal falls among seniors. These falls are the most common cause of injury among senior citizens. In addition, slip and fall accidents are the number one reason seniors over the age of 65 are hospitalized for trauma. The most common injury that results from a slip and fall accident is a fracture. Almost 90% of fractures among individuals over the age of 65 are due to a slip and fall accident. More than half of all falls occur in the individuals home.

Common fractures and injuries due to slip and fall accidents

  • Hip fractures
  • Femur fractures (Thigh bone)
  • Pelvis fractures
  • Spinal fractures (Vertebrae)
  • Humerus fractures (Upper arm)
  • Forearm
  • Hand fractures and injuries
  • Leg and ankle fractures
  • Head trauma
  • Lacerations
  • Deep bruising

Hip fractures and hip injuries are the most serious among seniors

Hip fractures are the most problematic injury among seniors. About 95% of all hip fractures sustained by seniors are due to falls. Annually there are nearly a quarter million hip fractures. Individuals over the age of 50 are more susceptible to hip injuries and fractures and women are twice as likely to suffer hip fractures from falls. Hip injuries and hip fractures cause more health problems and deaths than any other injury to seniors in the United States.

If you or a loved one has been injured or hospitalized due to a slip and fall and would like a free consultation with a senior injury attorney, please contact one of our Utah senior injury attorneys.

Injury prevention for seniors

Nearly one-half of individuals over the age of 65 never fully recover from injuries sustained due to slip and fall accidents. These injuries make it difficult for seniors to move around and live independently. Consequently, these injuries increase the risk of earlier death among seniors.

Accidents and injuries resulting from slip and fall accidents are preventable. Here are some precautions seniors can take to help prevent serious injuries and bone fractures.

  • Exercise regularly; engage in physical activity that will improve strength, mobility and flexibility.
  • Limit medications that cause drowsiness and sleepiness
  • Talk with your doctor about side effects caused by medications; identify any medications that may cause dizziness
  • Get appropriate treatment for medical conditions
  • Have regular eye exams and make sure your prescription lenses are updated to maximize vision
  • Make modifications to your personal residence; install grab bars in the bathrooms, add railings to stairways, improve lighting inside your homes, remove obstacles that could be a tripping hazard.

Utah Medical Malpractice

Have you had a serious Injury from improper medical treatment?

Since 1983, our attorneys have helped thousands of Utahns with questions and issues of medical malpractice. Jack Helgesen and Michael Houtz are two of Utah’s most experienced medical malpractice attorneys.

Medical cases are some of the most challenging and complicated cases an attorney can undertake. This is not an area of law practice to leave to an inexperienced lawyer.

Utah law requires a patient who claims an injury to prove:

  • the medical provider failed to meet the “standard of care” followed by other professionals treating the same condition, and;
  • the treatment (or failure to treat) caused an injury

Over the last twenty years, the Utah legislature has enacted many laws which limit or discourage Utahns from pursuing medical malpractice claims. We are able to work with, around and through these rules if you have a good claim.

If you think you may have suffered a serious injury from improper medical treatment, we will give you our best advice. Our approach is this:

  1. We will meet with you in a free consultation.
  2. If we think you may have a good claim, we will review your medical records and history.
  3. We may, in many cases, consult with experts in the medical field who work for us on a confidential basis.
  4. We will tell you frankly and honestly whether you have a case worth pursuing in the legal system, and whether we will accept the case.
  5. We will accept your case only if your injury is serious and only if we are convinced your case has merit. We do not accept frivolous cases.

If you would like to discuss a possible claim, please call us or come visit us at one of our locations.

Utah Medical Malpractice claims over $100,000

Because they need more care, seniors have a much higher risk of medical malpractice. Few attorneys in Utah have as more experience in these cases than we have, and even fewer have special training in Medicare related issues.

Wrongful Death

What is a wrongful death claim in Utah?

A Utah wrongful death claim is a demand for money by the heirs or estate of a person who died because of the fault of another.

Examples of Utah wrongful death claims:

  • Death from traffic accidents
  • Death from medical malpractice
  • Death from slip and fall Accidents
  • Death from product failures
  • Death from product defects
  • Death from dangerous prescription drugs and medications
  • Death from construction errors or bad highway designs
  • Death from electrocution mishaps
  • Death from gun negligence
  • And More

Contact one of our Utah  attorneys to find out if your loved one has a wrongful death claim.

The most common wrongful death claims are from traffic accidents. We have represented families of Utahns of all ages killed in car collisions, large truck crashes, pedestrian strikes, bicycle mishaps and motorcycle collisions. In the United States, almost 90 people are killed each day in motor vehicle accidents.

In our experience, the next most common cause of Utah wrongful death claims is medical malpractice. National studies show about 98,000 deaths each year from medical mistakes. We believe Utah has better health care than most of the country and the world, but Utah has it’s fair share of medical mistakes. These cases are very challenging and few Utah lawyers have the experience and training to win. Our Utah senior injury attorneys are experts in medical malpractice and have been leaders in the profession for more than twenty-five years.

Other examples of Utah wrongful death claims result from product failures, product defects, bad highway design, dangerous drugs and medications, construction errors, electrocution mishaps, gun negligence, careless handling of explosives, fires, and unsafe boating.

If you have lost a loved one and want to know what can be done, please call us for a confidential and free case evaluation.
